Please read these terms carefully before using the peak2partners platform or services. By accessing or registering an account, you agree to be bound by the terms below.
1. Acceptance of Terms
By accessing or using any part of the peak2partners website, dashboard, or affiliate services, you agree to comply with and be legally bound by these Terms and Conditions, together with our Privacy Policy and any additional guidelines posted on the platform. If you do not agree with any portion of these terms, you must discontinue use immediately.
2. Definitions
For the purposes of these Terms:
- “Network” means peak2partners and its affiliated companies.
- “Publisher” or “Affiliate” means any individual or entity approved to promote offers through the Network.
- “Advertiser” means any party that lists products, services, or offers within the Network.
- “User” means any visitor, Publisher, or Advertiser using the platform.
- “Offer” means a campaign, product, or service made available for promotion.
3. Eligibility and Registration
To register as a Publisher or Advertiser, you must provide accurate, complete, and current information. The Network reserves the right to approve, reject, or terminate any application or account at its sole discretion. You must be at least eighteen years old and legally capable of entering into binding contracts.
4. Publisher Obligations
Publishers agree to promote Offers only through approved traffic sources and in compliance with all applicable laws, regulations, and advertising standards. Prohibited activities include, but are not limited to:
- Fraudulent, misleading, or deceptive promotion;
- Use of spyware, malware, or forced clicks;
- Incentivized traffic unless explicitly permitted by the Offer;
- Violation of intellectual property rights;
- Any activity that damages the reputation of the Network, Advertisers, or end users.
5. Advertiser Obligations
Advertisers agree to provide accurate Offer terms, timely payment of commissions, and responsive support for products or services promoted through the Network. All advertising content must comply with applicable laws and must not promote illegal, harmful, or infringing materials.
6. Payments and Commissions
Commissions are calculated based on validated, tracked conversions as defined by each Offer. The Network processes payments according to the published schedule, subject to minimum thresholds and verification. Chargebacks, refunds, or fraudulent conversions may be deducted from pending payouts.
7. Confidentiality
Users may receive confidential or proprietary information through the platform. Such information must not be disclosed to third parties or used for any purpose outside the scope of the agreed relationship without prior written consent.
8. Termination
Either party may terminate the relationship at any time with written notice. The Network reserves the right to suspend or terminate access immediately for violations of these terms, fraudulent activity, or any conduct deemed harmful to the platform or its partners.
9. Limitation of Liability
To the fullest extent permitted by law, peak2partners shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to the use of the platform or services. Total liability shall not exceed the amount paid or payable to the User in the twelve months preceding the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Jerusalem, Israel.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms. Users are encouraged to review this page periodically.
